Clarifying the Planned 2027 Shutdown of the Newton Plant

The scheduled shutdown of the Newton facility in 2027 remains a strategic and regulatory necessity. This timeline is driven by the federal Coal Combustion Residuals (CCR) rule, which mandates the closure of all unlined CCR ponds and coal-fired power units by October 2028. In order to remain compliant, ceasing operations at Newton by 2027 is essential to allow adequate time for the safe and orderly closure of the site.

While a recent Executive Order was issued by the current administration, it does not provide the level of regulatory certainty required to consider an extension of Newton’s operational timeline. Regulatory clarity is vital for compliance planning and long-term investment decisions. Furthermore, it would be beneficial if the Administration allowed companies to begin the closure process proactively. Such an approach could provide certainty around the applicable closure standards, especially for facilities that intend to continue operations using alternative, dispatchable, and domestically abundant fuel sources.

It is also important to note that under the Illinois Climate and Equitable Jobs Act (CEJA), Newton is required to close no later than 2030. The Executive Order has no impact on this state-level legal requirement.
